Terms of Service
Terms of Service:
(Throughout this document, 'Mockpad' refers to the Mockpad website, the application hosted thereon, the application's creator(s), and any other corporations, organizations, and individuals associated with the creation or operation of the Mockpad application.)
Content you create and assets you upload are your own, but making either available publicly constitutes an agreement to allow other users to fork, copy, and download that intellectual property for their own use.
You are responsible for the legality of content you reuse or create and assets you reuse or upload. By using this application, you accept all liability for damages or violations of any kind arising from your use of this application, including intellectual property violations, illegal content, and other damaging activities, whether that damage arises directly from your activities or as an extension of your activities.
You agree to hold Mockpad and its users and all associated entities blameless for such violations, to indemnify them against any damages resulting from such violations, and to defend them against any claims, demands, suits, or proceedings that may arise from your use of this application.
Mockpad does not pre-screen content, but reserves the absolute right to restrict, refuse, or remove, content and/or users at our sole discretion and for any reason whatsoever, without notice, warning, or recourse.
If we refuse to restrict, refuse, or remove reported content, that does not constitute an endorsement of it or an acceptance of liability for it, but at most a determination that it does not apparently violate our terms of service.
Except as explicitly noted, Mockpad offers no guarantee or warranty to users, including but not limited to any pertaining to availability, security, compliance, or quality. Additionally, you agree to resolve any legal disputes with Mockpad through arbitration whenever possible, and in a location convenient to those you're pursuing action against.
Mockpad reserves the right to restrict or remove features at any time, and to remove access to the application altogether, for any reason and without warning or recourse, though we hope to continue offering a rich experience to all users.
Apart from the three exceptions listed below, Mockpad is a proprietary closed-source application. No permission is granted to download, reuse, share, extend, or otherwise make use of any Mockpad software, source code, or assets. Unauthorized use or reuse may result in requests to cease and desist, warnings, or legal action. If you're curious about aspects of our application or would like permission to reuse specific components, contact us and we may be able to help you. We worked very hard on this site and we ask that users and visitors respect that.
Exceptions to the above paragraph are as follows:
1. Any Mockpad-created and -owned code and assets, which are deliberately made available through the Export feature, whether or not they're actually obtained through that Export feature. These are offered under the Creative Commons open-source license, and can be reused freely both commercially and non-commercially without attribution, though we appreciate all attributions of Mockpad, and in keeping with the Creative Commons license, you accept all risks and liabilities associated with use of such code and assets.
2. Third-party software and assets such as Google Fonts (tm), nicEdit, the Font-Awesome (tm) icon library, the jQuery library, and similar third-party assets all listed in the Attributions section below, which each have their own individual licenses clarified in their source files or on their source websites. ALL THIRD PARTY SOFTWARE EXPLICITLY SUPPORTED BY MOCKPAD AND ATTRIBUTED BELOW PERMITS FREE COMMERCIAL REUSE, including Google Fonts and the Font-Awesome icon library, but specific requirements for their reuse vary slightly. Use of those components constitutes your understanding of and agreement to their licenses and reuse requirements and the risks entailed in using them, and your indemnification of Mockpad for any legal issues that may arise from such use. We've worked hard to select tools and assets that you can reuse with only minor restrictions such as but not limited to attribution.
3. User-uploaded, -reused, or -created content, code, and assets, both within export downloads and within the overall application, which are offered under the terms their creator/uploader specifies, and in accordance with the terms of service specified here. Please be mindful of the liability risks of reusing content, code, or assets uploaded or created by other users. When in doubt, contact them directly with any questions, or avoid using such assets altogether.
These terms are subject to change as this tool develops, and users will be notified if they do. This particular version is number 0.11.
Privacy:
Mockpad DOES NOT, and will not, sell user data and content to third party services for the purpose of marketing or other unsavory purposes. This promise will also be explicitly written into any sale or investment contract, and if need be will continue beyond the solvency of Mockpad itself. We encourage open collaboration and free exchange of ideas, and view the productization of users, or the violation of their privacy or the privacy of their content, as a threat to that openness.
Mockpad DOES retain the right to utilize user data and content for internal purposes such as quality of service, content evaluation, improvements, and communication, and to work with third parties for purposes such as those described.
Mockpad DOES also retain the right to cooperate with any proper law enforcement requests, DMCA requests, and legal judgements and orders. Dangerous or illegal content found within Mockpad may also be reported to the appropriate authorities without request, along with IP address and other data that might help keep our users and the general public safe.
Attribution & Licensing:
Mockpad is a proprietary web application developed by Jeffrey Richman (http://www.jcrichman.com/)
Mockpad uses several third party libraries and assets. License details and full attribution for those can be found in the library files linked from the source code, but a quick summary follows.
(IMPORTANT - these libraries have nearly all been slightly customized for use in Mockpad, and few if any of those customizations have been documented. All modifications fall under the original library licenses and you're welcome to reuse our versions of them, but be careful doing so as the code likely differs significantly from the original source and documentation. Mockpad accepts no responsibility for problems that arise as a result, but if you have trouble you can contact us and we might be able to assist.)

Special thanks to:
Tim Down (again) for development and support of the Rangy class library used extensively by nicEdit and tremendous expertise in dynamic javascript selection and range manipulation.
Brian Kirchoff for development of nicEdit (http://nicedit.com/index.php), which was used as the foundation for Mockpad's extremely sophisticated custom rich text editor, which falls under nicEdit's original MIT License and will eventually be made available separately. This source code and accompanying assets is located in /nicedit_modified/nicEdit_inline.js, and includes files in that same directory and its children.
IRC channel #regex on the Freenode network, and the regex test and evaluation utility at https://regex101.com/, both for tremendous assistance with regular expressions.
